How far has my case progressed?

It isn’t always easy to keep track of what’s required during the various phases of a collection case. To enable you to get your bearings concerning you case, we have assembled frequently asked question, presenting them in the order of the phases of a typical case. In this example, debt increases fast

Kim is a fictional character, but his story is realistic. The actual time intervals may vary, but the point is to demonstrate how quickly and drastically a debt may increase, if ignored.

Agreement reached

When two parties reach an agreement, it constitutes a contract. It is not required to be in writing. The decisive factors are that one party has made an offer (proposal) which the other party has accepted (agreed to). A common example of a contract is when a person buys a product from a company. The company commits to delivering the product, while the customer commits to paying the agreed-upon sum of money. QUESTION? What type of contract is preferable?
ANSWER! An oral contact may be hard to prove in case of a later disagreement, rendering a written contract preferable. In some cases, a written contract is mandatory for it to be valid. Examples are real estate and condominium contracts.
QUESTION? Can anyone enter into a contract?
ANSWER! Anyone over the age of 18 may enter into a contract. Below that age, consent from a parent or guardian is mandatory for the contract to be valid.

Kim buys a set of good headphones, costing 1 000 SEK. Kim finds that to be a bit much to pay on a single occasion, so he decides to pay in instalments instead. He’s required to pay 200 SEK per month for 5 months. The payment plan increases the cost through an interest rate of 19.90%, effective immediately.

Invoice

Issuing an invoice is a common way of charging a customer. Among other things, the invoice must contain information about both the seller and the buyer, the product or service sold, the amount to be paid as well as the date payment is due. QUESTION? What happens if an invoice is not paid in time?
ANSWER! Companies will normally grant the buyer a credit period, 14 days, for instance. If so, the 14th day becomes the invoice’s expiry date. If payment is not made before the expiry date, a reminder notice is sent out. If the contract between the parties stipulate it, a reminder charge may be added to the customer’s debt. Usually, late-payment interest will begin to apply on the invoice expiry date as well. If an invoice is not paid, the issuing company may choose to turn the matter over to a debt collection company. The debt collectors will then issue a debt collection demand. If the invoice still goes unpaid, the matter may be sent to the Swedish Enforcement Authority. This may result in the debtor being recorded for the payment default, which may result in difficulty obtaining loans in the future.
QUESTION? What is an expiry date?
ANSWER! The expiry date is the final payment deadline for an invoice, i e the final date that an invoice must be paid.
QUESTION? What is an OCR number?
ANSWER! The OCR number is normally found in the footer of an invoice. The OCR number is a unique string of numbers used during the payment process to connect the payment to the correct customer.
QUESTION? What is an invoice service charge?
ANSWER! The invoice service charge is added to cover the company’s administrative costs for issuing the invoice.
DAY 5-30
The invoice is sent

Day 5. Invoice sent – condition of payment 30 days
The creditor sends the invoice to Kim, for a service charge of 29 SEK. At this point, Kim becomes aware of spending more money than planned during the past month. He decides not to pay the invoice right now.


Day 30. The invoice lapses.
Since Kim haven’t paid according to contract, his debt is now 1 049 SEK.

Reminder

QUESTION? How much may a company charge for issuing a reminder?
ANSWER! A charge for a written reminder is only permitted if it has been agreed upon when the contract was concluded. The maximum reminder charge is currently 60 SEK.
QUESTION? Is the company required to issue a reminder notice before any debt collection demand?
ANSWER! In most cases, there exists no obligation to issue a reminder, but most creditors choose to issue one before the demand for debt collection.
DAY 36-46
A reminder is issued

Day 36. A reminder is issued.
Kim has a forgotten about the matter when an envelope arrives. The reminder charge is 60 SEK and the interest has increased to 24 SEK. Once more, Kim chooses not to pay.

 

Day 46. Kim’s credit is cancelled.
Since Kim hasn’t paid after receiving the reminder, the creditor now cancels Kim’s credit, giving him 30 days in which to pay the debt. Kim forgets to pay.

Debt collection demand

If an invoice remains unpaid, the the company demanding the payment may turn the matter over to a debt collection company, which then issues a debt collection demand, adding a collection charge of 180 SEK. With the debt turned over to the collectors, any payments must be made to them instead of to the original creditor Don’t let you debts get out of hand. QUESTION? What happens if a debt collection demand is not paid?
ANSWER! In case of non-payment after a debt collection demand, the debt collection company may pass the case on to the Swedish Enforcement Authority which will then issue an injunction to pay. This means that the Enforcement Authority sends a message (the injunction) to the debtor with the debt collector’s payment demand. The debtor may then pay the debt, including any interest and charges. In that case, the debt collection company will retract the Enforcement Agency’s injunction. If not, the Enforcement Agency may instead issue a ruling. This means that the debt is established and may be utilized to seize the customer’s property, i e taking a portion of his or her salary or belongings as payment for the debt. This will also result in a record of non-payment.
DAY 76

Coming home from work, Kim finds an letter from a debt collection company on his doormat. They collectors have taken over the debt from the online vendor. On top of his debt and other charges, he’s now required to pay a further 180 SEK due to the debt collection demans. Kim chooses to further ignore his debt.

Order to pay

If a debt collection demand is not met, the debt collection company may turn over the matter to the Swedish Enforcement Authority for the issue of an order to pay. This means that the Enforcement Agency orders the debtor to pay the debt collection company. Applying for an order to pay entails paying a charge of 300 SEK. Normally, an additional 380 SEK fee for legal representation also applies. These costs will added to the customer’s debt. Don’t let you debts get out of hand. QUESTION? Why is an order to pay applied for?
ANSWER! When a person has received an order to pay through the Swedish Enforcement Authority, he or she is given a certain amount of time to pay the owed sum. If no payment is received, the Enforcement Authority has the right to seize the debtor’s property or pay. The seizure is normally handled by the Enforecment Authority.
QUESTION? Will an order to pay result in a record of non-payment?
ANSWER! If the customer pays the debt in full within the time allotted by the Enforcement Authority, the Authority will close the case and the customer will not acquire a record of non-payment. If the customer doesn’t pay before the specified deadline, a record of non-payment will be issued.

Ruling/Record of non-payment

If a person has received an order to pay through the Swedish Enforcement Authority, he or she has a specified period in which to pay the amount owed. If the debtor doesn’t pay, the Enforcement Authority will rule to establish the debt. This means that the Authority has the right to seize (take) the person’s possessions/pay. QUESTION? What’s the consequences of a ruling?
ANSWER! A ruling can be used to seize property owned by the debtor, as well as salary or other remuneration received by the person. Seizure with normally be handled by the Enforcement Authority. Such a ruling will also result in a record of non-payment. The record remains for three years and may affect the person’s opportunities to be granted a loan, renting an apartment etc.

QUESTION? How can I avoid seizure by the Enforcement Authority?
